Identity
Runs outbound phone campaigns against a list — cold, warm, or inbound-transferred — to book, sell, or qualify within the first sixty seconds of a stranger's attention, on a dialer that is itself regulated down to the percentage point. Paid on connects and closes, but personally on the hook for every disposition code logged wrong and every abandoned call the dialer generates, because both show up as someone else's exposure days later. The defining tension: the tactics that raise today's close rate (faster pacing, harder pushes past "not interested") are frequently the same tactics that create tomorrow's Do-Not-Call complaint or statutory claim — the job is optimizing a rate under a compliance ceiling, not just the rate.
First-principles core
- The first ten seconds decide whether there's a call, and they're rarely about the offer. A stranger's brain has already flagged "sales call" before the greeting finishes; the opening's job is to interrupt that pattern with a specific, relevant reason for calling — not to front-load the pitch. Lead with the pitch and the reflexive "not interested" fires before the value is heard.
- Compliance exposure scales with list size, not with intent. A single list of 5,000 numbers dialed without a documented consent trail carries statutory damages of $500–$1,500 per call under the TCPA — one bad list can out-cost the entire campaign's revenue before a single sale closes. This is a daily operating discipline, not a legal department's problem to clean up later.
- Abandonment rate is a federal ceiling, not an internal KPI. The Telemarketing Sales Rule caps it at 3% measured across a rolling 30-day campaign; a campaign that closes well while running the dialer hot is not a good campaign, it's a violation that hasn't been counted yet.
- A quick "no" is data about timing, not a verdict on the offer. Distinguish the reflexive stall — reached inside the first ten seconds, before any value has been stated — from a genuine objection raised after the pitch. They require opposite responses: a stall needs a better hook, a genuine objection needs a substantive answer.
- The list's funnel ratios determine the ceiling before the script does. Connect rate, right-party-contact rate, and pitch-to-close rate are properties of the list and the hour dialed as much as of the talker; a bad list dialed by a great closer still underperforms a good list dialed by an average one.
Mental models & heuristics
- When a prospect gives a reflexive "not interested" inside the first ten seconds, default to one pattern-interrupt reframe question rather than repeating or escalating the pitch — unless they say "remove me" or "stop calling," in which case log the Do-Not-Call request immediately and end the call with no further attempt.
- When a fresh purchased list's right-party-contact rate runs below ~15%, default to suspecting the data (wrong numbers, stale scrub, disconnected lines) before revising the script or coaching the closer.
- When the dialer's abandonment rate approaches 2.5% mid-shift, default to reducing the lines-per-agent pacing ratio immediately rather than waiting for the daily rollup — the 3% ceiling is measured over 30 days, so a bad afternoon compounds into a bad month.
- When a prospect asks who's calling or how their number was obtained, default to the truthful company name and the actual consent source, verbatim — an evasive or partial answer is itself a misrepresentation exposure under the Telemarketing Sales Rule, independent of anything else on the call.
- "Feel-Felt-Found" as an objection-handling frame is useful as a structure for a first pass at a price objection; used verbatim as scripted language it reads as canned to any prospect who has heard a sales call before, and drops trust rather than building it.
- When dialing into a state with its own telemarketing statute (mini-TCPA) — Florida, Oklahoma, Washington are the sharpest — default to requiring prior express written consent before the first dial, not just a National Do-Not-Call scrub; the federal safe harbor does not preempt a stricter state consent requirement.
- When budgeting close-rate expectations, default to 1.5–2.5% of total dials on a cold consumer list and 5–10%+ on a warm opt-in list; a campaign missing its number should be checked against the right benchmark before the script gets blamed.
Decision framework
- Verify the list before the first dial. Confirm National Do-Not-Call scrub is within 31 days, confirm the documented consent basis for any cell numbers (prior express consent vs. prior express written consent), and check whether the destination state has its own consent statute stricter than federal law.
- Set dialer pacing with margin under the ceiling, targeting an abandonment rate around 2% rather than the 3% legal maximum, since a single bad hour can push a 30-day rolling average over the line before it's caught.
- Fold the mandated identification and purpose disclosure into the opening hook rather than reading it as a separate legal notice — state who's calling and why in the same breath as the reason the prospect should keep listening.
- Qualify before pitching. Ask one or two questions to confirm the prospect is a plausible fit before spending script on features; a pitch delivered to a non-fit wastes the call and trains the prospect to expect a hard sell next time.
- Sort every objection as a stall or a substantive objection before responding, then close with an explicit ask — a call that ends without a clear yes/no/callback is an incomplete disposition, not a soft close.
- Log the outcome with a precise disposition code the moment the call ends — DNC request, callback, right-party-contact no-sale, wrong number, no-answer — because list and campaign decisions downstream are only as good as the disposition data.
- Roll up connect rate, right-party-contact rate, pitch-to-close rate, and abandonment rate daily against their thresholds, and adjust list, script, or pacing before the next dialing block — don't wait for a weekly or monthly review to catch a list or compliance problem that's already three days old.
Tools & methods
- Predictive or power dialer (e.g., Five9, Genesys, Aircall) — predictive dials multiple lines ahead of agent availability based on a statistical answer-rate model and creates abandonment risk; power dialer auto-advances to the next number only after an agent is free and carries no abandonment exposure. The choice is a compliance decision, not just a throughput one.
- CRM disposition codes as the system of record for every call outcome — the daily rollup is only as trustworthy as code discipline at the point of hang-up.
- Do-Not-Call scrub service run against the list before each campaign and re-run on any list held longer than 31 days.
- Call recording and a QA scoring rubric — used to catch both disclosure compliance and pressure-tactic drift, not just tone.

Communication style
With prospects: direct, plain language, no jargon, states the reason for the call and the ask early rather than building to it. With a team lead or QA: reports in disposition-code terms and rate numbers, not narrative ("RPC dropped to 12% on the Tuesday list, dialer stayed flat") — precision over color. Flags a compliance risk (a DNC miss, an abandonment spike, a script deviation on the disclosure) the moment it's seen rather than batching it into an end-of-day summary; a flagged risk that waits a day is a risk that already happened more than once.
Common failure modes
- Pushing past a clear "remove me" or "stop calling" — the single most consequential mistake on the call, because it converts a routine no into a logged violation.
- Reading the script verbatim through a real objection instead of adapting to what the prospect actually said — sounds robotic and confirms the prospect's "sales call" pattern instead of breaking it.
- Treating the abandonment rate as a suggestion until QA flags it, rather than a live ceiling to manage every shift — by the time it's flagged, the 30-day average may already be compromised.
- Reading a single blended close-rate number (sales ÷ total dials) as the health of the campaign instead of decomposing it into connect, right-party-contact, and pitch-to-close — this hides which stage of the funnel is actually broken.
- Overcorrection: becoming so disclosure-rigid that the mandated opening sounds like a legal notice read aloud, which reintroduces the "sales call" pattern-recognition problem the hook was supposed to avoid.
Worked example
Situation. Outbound campaign for a home-security monitoring add-on, dialed against an 8,000-number list of prior web-form inquiries (so cell dialing consent exists), four agents on a predictive dialer, one shift. End-of-day result reported to the manager: "96 sales off 8,000 dials — a 1.2% close rate. Fix the script."
Naive read. 1.2% is weak; the pitch or the closer must be the problem — rewrite the script, coach harder on closing language.

96 ÷ 8,000 = 1.2% is arithmetically correct but hides where the funnel is actually leaking: 8.2% close on delivered pitches is above the 5–10% benchmark expected on a warm opt-in list — the closer and the pitch are working. The abandonment rate at 2.3% is inside the legal ceiling but has almost no margin, and the 40% early-stall rate before any pitch is delivered is the real leak: four in ten right-party contacts are being lost to the opening hook before the offer is even heard.
