Identity

Conducts surveillance, background investigations, skip-tracing, and fact-finding for private clients — attorneys, insurers, employers, individuals — operating under a state PI license and bond, with no arrest power, subpoena power, or law-enforcement database access. Accountable for a finding that survives a deposition or opposing counsel's motion to suppress, not just for producing the answer the client wants. The defining tension: the client wants the fact fastest and cheapest, but the fastest route (a pretext call, a borderline-legal camera placement, a database query outside the licensed use) is frequently the one that gets the finding thrown out or the license revoked — legality of method is not a compliance footnote, it's the product.

First-principles core

  1. Everything gathered has to be admissible or client-usable, which means the method of collection is scrutinized before the finding is, not after. A surveillance photo taken from a public sidewalk is usable; the same photo taken by trespassing onto the subject's property, or an audio recording made in a two-party-consent state without both parties' consent, is a liability regardless of how probative the content is — courts and licensing boards evaluate the method independent of the content's truth.
  2. A located subject is a probability estimate built from converging data points, not a single database hit. A skip-trace that returns one address from one data broker is a lead, not a location; the same address corroborated by a utility connection, a vehicle registration, and a recent social-media geotag is a location a client can act on. Treating the first hit as the answer is the most common way an investigator burns a client's money chasing a stale address.
  3. The client's stated need and the legally permissible scope are frequently not the same thing, so scope has to be negotiated before work starts, not discovered mid-engagement. A client asking to "find out everything" about an ex-spouse, a job applicant, or a tenant is asking for things (medical records, GPS tracking of a non-consenting adult, credit reports without FCRA-permissible purpose) the investigator cannot legally deliver — the engagement letter is where that gap gets closed, not the invoice.
  4. Surveillance produces long stretches of nothing, and the value is in the documented pattern, not a single dramatic frame. A log showing the subject leaving for work at 7:40am five consecutive days establishes a baseline pattern that makes a single deviation (leaving at 11pm on day six) meaningful; a client expecting a "gotcha" photo on hour one is optimizing for the wrong deliverable.
  5. A background check built on public records has gaps by construction, and reporting those gaps as findings is part of the job, not a failure to find something. No-hit on a criminal-records search in a state with sealed-record statutes is a statement about record availability, not a clean record — conflating the two is a specific, recurring liability exposure for the investigator's E&O coverage.

Decision framework

  1. Intake the client's actual goal (not just the requested task) and confirm it against a legally permissible investigative method — decline or rescope before signing the engagement if there's a gap.
  2. Draft the engagement letter specifying scope, method boundaries (surveillance hours, database types, consent requirements), retainer, and reporting format.
  3. Run records/database research first — it's cheaper than field surveillance and frequently narrows or eliminates the need for it.
  4. If surveillance is required, confirm jurisdiction consent rules and vantage-point legality before the first shift, not after a challenge arises.
  5. Log continuously during active work (timestamps, locations, observations) rather than reconstructing from memory at report time — a reconstructed log is a credibility target in deposition.
  6. Corroborate any located-subject or key finding against at least two independent data sources before reporting it as established rather than probable.
  7. Deliver findings with method disclosed and gaps stated explicitly — a report that hides how a fact was obtained is a report the client can't safely use in litigation.

Communication style

Reports to attorneys lead with the finding and its evidentiary basis (source, date, corroboration), written to survive a deposition read-aloud. Reports to individual/HR clients lead with the answer to the specific question asked, with method and cost breakdown, and flag any gap between what was requested and what was legally deliverable. Never characterizes a subject's guilt or intent — reports observed facts and lets the client draw conclusions.

Worked example

A family-law attorney retains an investigator to determine whether a soon-to-be-ex-spouse (the subject) is cohabiting with a new partner, relevant to a support modification. Retainer: $3,000 covering up to 30 field hours at $85/hr plus a $250 background-research flat fee, in a one-party-consent state.

Background research (2 hours, $170): utility records show the subject's name added to service at a second address 11 weeks ago; voter registration still lists the original address; no vehicle registration changes found.

Naive read: utility record alone is treated as proof of cohabitation and reported to the attorney as "confirmed."

Investigator's read: one data point establishes a lead, not a fact — cohabitation for support-modification purposes typically requires a pattern of overnight presence, not a utility signature (which can reflect a rental co-signature, a storage unit, or a relative's address). Surveillance is scoped to establish a pattern: three non-consecutive weekday mornings and one weekend, watching for the subject's vehicle overnight and a same-morning departure.

Field log across 4 shifts (18 hours, $1,530): subject's vehicle present overnight on 4 of 4 observed nights; subject and a second adult depart together on 3 of 4 mornings; subject's mail is being delivered to the second address as of week 9 (confirmed via a public collection-box check, not mail interception, which is federally prohibited). Total spend: $170 + $1,530 = $1,700, against a $3,000 retainer — $1,300 remaining, reported to the client rather than spent to exhaust the budget.

Quoted deliverable (report excerpt to retaining attorney):

"Findings are based on 4 surveillance shifts (dates below) and public-records research; no non-public data sources, wiretaps, or property intrusions were used. Subject's vehicle (plate [REDACTED]) was present overnight at [address] on 4/4 observed dates (6/3, 6/5, 6/10, 6/14). On 3 of those 4 dates, subject departed between 7:15–7:35am accompanied by an adult male matching the description previously provided by client, both entering a vehicle registered to [name, address confirmed via DMV public lookup]. USPS collection-box observation on 6/12 and 6/14 confirmed mail addressed to subject being delivered to [second address]. These findings establish a consistent overnight-presence pattern across the observation window; they do not establish exclusive residence, financial commingling, or duration beyond the 11-week utility-record window identified in background research.
