Accountable for one tension above the rest: payroll has a hard weekly or biweekly deadline that doesn't move, but the Fair Labor Standards Act's overtime math is not the simple "hours over 40 times 1.5" most people assume — getting it wrong on deadline is still getting it wrong, and it compounds every pay period until caught.

First-principles core

  1. The regular rate of pay is total compensation divided by total hours, not the posted hourly wage. Under FLSA (29 CFR Part 778), any non-discretionary payment tied to the workweek — a production bonus, a shift differential, a non-discretionary attendance bonus — must be folded into the regular rate before calculating the overtime premium. Paying overtime at 1.5x the base hourly rate while a bonus sits outside that calculation understates every overtime hour in the period the bonus covers, and it is a wage violation the moment the check is issued, not a rounding error.
  2. A garnishment order's withholding limit is a ceiling set by law, not by the creditor's request. The Consumer Credit Protection Act caps most ordinary garnishments at the lesser of 25% of disposable earnings or the amount by which disposable earnings exceed 30 times the federal minimum wage; child-support orders can reach 50–65% depending on the employee's other support obligations and arrears status. Withholding more than the applicable cap exposes the employer to liability to the employee, independent of what the order itself says to withhold.
  3. Disposable earnings, not gross pay, is the garnishment base. Disposable earnings is gross pay minus legally required deductions only (taxes, FICA, mandatory retirement contributions) — voluntary deductions like health insurance or a 401(k) match do not reduce it. Calculating a garnishment cap against gross pay overstates the allowable withholding; calculating it against net pay after voluntary deductions understates it — both are wrong in opposite directions.
  4. A timesheet exception caught before the run locks costs one correction; one caught after costs an off-cycle check. Once payroll is transmitted, fixing an error means either waiting until the next regular cycle (which may violate state final-pay-timing laws if the error was an underpayment) or issuing a manual off-cycle payment, which carries its own tax-withholding and reconciliation overhead. The exception-review window before lock is the cheapest point in the entire process to catch a problem, and it is also the one most likely to get skipped under deadline pressure.
  5. Multiple garnishment orders stack in a priority order, not a first-come order. Child support and certain federal tax levies generally take priority over consumer-debt garnishments, and the combined withholding across all active orders still cannot exceed the individual employee's aggregate CCPA cap — processing orders in the sequence they arrived, rather than by legal priority, can result in withholding a lower-priority debt while starving a legally mandatory one.

  2. For any employee with overtime hours in a period that also includes a non-discretionary bonus, shift differential, or commission, recalculate the regular rate of pay by dividing total workweek compensation by total hours worked, and apply the overtime premium to that recalculated rate.
  3. Apply all standard withholdings (tax, FICA, benefits elections) in the order specified by payroll system configuration and employer policy.
  4. Check for active garnishment orders; if more than one order is active, apply priority rules (support and tax levies first) and confirm the combined withholding does not exceed the employee's CCPA aggregate cap based on disposable earnings.
  5. Run a pre-transmission exception report and resolve every flagged item — do not transmit with an unresolved flag on the assumption it can be fixed next cycle.
  6. After transmission, reconcile the payroll register total against the general-ledger payroll expense account; investigate any variance before closing the period.
  7. For any post-lock error discovered, determine whether state final-pay-timing rules require an immediate off-cycle correction or whether it can wait for the next regular cycle, and document the correction and its cause.

With the employer's legal or HR counsel: precise citation of the rule being applied (FLSA regular-rate calculation, specific state final-pay statute) rather than a paraphrase, since a paraphrase that drifts from the actual rule is how compliance gaps get missed.

An hourly employee earns a $18.00/hour base rate and worked 46 hours in a workweek that also included a $150 non-discretionary production bonus tied to that week's output.

Naive calculation (bonus treated as separate from overtime): 40 straight-time hours × $18.00 = $720.00, plus 6 overtime hours × $18.00 × 1.5 = $162.00, plus the $150.00 bonus paid separately. Total: $720.00 + $162.00 + $150.00 = $1,032.00.

Correct FLSA calculation: total workweek compensation excluding the overtime premium = (46 hours × $18.00) + $150.00 bonus = $828.00 + $150.00 = $978.00. Regular rate of pay = $978.00 ÷ 46 hours = $21.2609/hour. Because straight-time pay for all 46 hours is already included in that $978.00, only the additional overtime *premium* (the extra half) is owed on top: 0.5 × $21.2609 × 6 overtime hours = $63.78. Total correct pay: $978.00 + $63.78 = $1,041.78.

Discrepancy: $1,041.78 − $1,032.00 = $9.78 underpaid for this one employee, this one pay period, under the naive method. Multiplied across a 26-pay-period year and a workforce where bonus-eligible overtime is common, this is a recurring liability — and FLSA underpayments carry potential liquidated damages equal to the shortfall, plus a two- or three-year lookback if a Department of Labor audit finds a pattern rather than an isolated error.
