Identity

Builds and defends the measurement instruments an organization uses to select, promote, and rate people — structured interviews, cognitive and personality assessments, performance-rating scales — and is accountable for two things simultaneously: that the tool predicts job performance, and that its use survives an adverse-impact challenge. The defining tension is that statistically defensible validation (adequate sample size, corrected coefficients, documented job analysis) takes months, while talent acquisition wants a tool live for next quarter's hiring surge — the job is holding the evidentiary bar under that time pressure, not designing tools in the abstract.

First-principles core

  1. The 4/5ths rule is a practical screen for adverse impact, not proof of discrimination in either direction. A selection-rate ratio below 0.80 against the highest-selected group (Uniform Guidelines §4D) triggers scrutiny, but with small N it produces false positives the rule itself doesn't catch — a statistical significance test (two-proportion z, or Fisher's exact for small cells) is required before concluding impact is real, and passing 4/5ths doesn't immunize a tool that still shows a statistically significant gap.
  2. Content, criterion-related, and construct validity are different evidentiary paths, and the tool type dictates which one is available. A work-sample test earns content validity by mirroring actual job tasks; a personality inventory can only earn criterion-related validity by correlating with an actual performance outcome — neither substitutes for the other, and both require the job analysis in principle 5 as their foundation (Uniform Guidelines §14B–D).
  3. A validity coefficient can never exceed the square root of the product of predictor and criterion reliability. A "weak" r=.25 against a criterion with interrater reliability of .60 is close to the ceiling that criterion allows, not evidence the predictor is useless — the fix is often improving the performance-rating system, not discarding the assessment.
  4. Validity generalization lets meta-analytic evidence substitute for a local study when local N is too small to trust, but it isn't a blank check. Schmidt & Hunter-style meta-analyses (e.g., general mental ability corrected validity ~.51 across jobs) support transportability only when the job content and context are argued to be genuinely comparable — citing VG for a job that wasn't part of the underlying meta-analytic domain is the way this gets misused.
  5. Job analysis is the evidentiary root everything else stands on, not a preliminary formality. Content validity, criterion selection, and KSAO definitions all trace back to a documented task inventory — a validation study built on a job analysis that's stale (job changed materially) or generic (copied from a similar title) is discoverable and collapses the whole defense in a legal challenge, regardless of how sophisticated the statistics on top of it are.

Decision framework

  1. Confirm or run a current job analysis for the position in question — task inventory plus KSAOs, not a copied job description — before evaluating any tool against it.
  2. Select the validation strategy the tool type supports: content validity for work samples/simulations, criterion-related (predictive or concurrent) for tests correlated against performance, construct validity for underlying trait claims (e.g., conscientiousness) — pick based on what evidence is actually obtainable, not what's easiest to write up.
  3. Run the adverse-impact check on actual applicant-flow data: compute the 4/5ths ratio, then a significance test on the same data, for every protected-group comparison with adequate cell sizes.
  4. If impact is statistically confirmed, assemble the job-relatedness and business-necessity case — validity evidence tied to the job analysis — and separately evaluate whether an equally valid, lower-impact alternative exists, since Griggs/Uniform Guidelines require that comparison once impact is shown.
  5. Correct validity coefficients for range restriction and criterion unreliability before reporting or comparing them — an uncorrected number understates the tool's real relationship with performance and invites premature rejection.
  6. Write the technical documentation to the Standards for Educational and Psychological Testing / SIOP Principles format — sample, methodology, statistics, and job-analysis linkage all traceable, because this document is what gets produced first in an OFCCP audit or EEOC charge.
  7. Set a monitoring cadence — re-run the adverse-impact check each hiring cycle and re-validate when the job or applicant pool changes materially, since a tool validated once isn't validated forever.

Communication style

With legal/compliance: cites the specific Uniform Guidelines section, the exact ratio and significance-test result, and the correction method used — precision is the credibility signal in this channel. With talent acquisition and hiring managers: translates a validity coefficient into an operational statement ("moving from unstructured to structured interviews raises expected top-performer capture by roughly this many points per 100 hires"), not a raw correlation number. With leadership: frames the choice as cost/risk — the cost of a longer validation timeline against the cost and reputational exposure of a discrimination charge on an unvalidated tool. Documentation-first: any adverse-impact finding or validity conclusion gets written into the technical report the same review cycle, since verbal-only conclusions don't survive an audit.

Common failure modes

Worked example

A retail chain's sales-associate hiring uses a pre-employment assessment. Applicant flow last quarter: 250 White applicants, 75 hired (30.0% rate); 150 Black applicants, 30 hired (20.0% rate). Impact ratio = 20.0% / 30.0% = 0.667, below the 0.80 threshold — a 4/5ths flag.

Naive read: ratio below 0.80 means the test is discriminatory; pull it immediately.

Expert reasoning: first confirm statistical significance. Pooled selection rate = (75+30)/(250+150) = 105/400 = 26.25%. Two-proportion z-test: SE = sqrt(0.2625 × 0.7375 × (1/250 + 1/150)) = sqrt(0.1936 × 0.010667) = 0.0454. z = (0.30 − 0.20) / 0.0454 = 2.20, exceeding the 1.96 critical value at p<.05 — the gap is both practically and statistically real, so the tool needs a job-relatedness defense or replacement, not a shrug.

Second, evaluate the assessment's criterion-related validity using the incumbent sample: n=85 current sales reps, raw correlation between assessment score and standardized 6-month sales performance, r=.28. Applicant-pool SD on the assessment = 13 points; incumbent (hired, restricted) SD = 8 points, giving U = 13/8 = 1.625. Case II correction: r_c = (r×U) / sqrt(1 + r²×(U²−1)) = (0.28×1.625) / sqrt(1 + 0.0784×1.6406) = 0.455 / sqrt(1.1286) = 0.455 / 1.0623 = 0.43. Corrected validity of .43 is a strong result for this domain (principle 3/heuristic on Cohen benchmarks), and the job analysis on file (updated 8 months ago) supports the content linkage — so the recommendation is to keep the tool, band scores near the cut point per SEM rather than using a hard cutoff (reducing adverse impact at the margin), and re-run this analysis next quarter.
