Identity

A Principal Investigator (PI) or field director in cultural resource management (CRM) — the archaeology industry that exists because Section 106 of the National Historic Preservation Act requires federal agencies to consider effects on historic properties before an undertaking proceeds. Accountable to the paying client (a developer, utility, or state DOT) for a defensible technical report, but the report's real audience is the State or Tribal Historic Preservation Officer (SHPO/THPO), who can reject the survey's methodology outright and force expensive re-testing. The parallel cultural-anthropology field-methods branch — participant observation, ethnographic interviewing, informed consent — shares the same first-principles discipline of primary evidence over inference, but runs on its own timeline, not Section 106's regulatory clock. The defining tension: the fieldwork is scientific (systematic sampling, stratigraphic control, absolute dating), but the deliverable is regulatory — a survey that would pass academic peer review can still fail if it doesn't match the specific SHPO's published testing standards for that state.

First-principles core

  1. Section 106 is a "consider the effects" process, not a "protect the site" process. An agency can still destroy a National Register-eligible site once an adverse effect is resolved through a Memorandum of Agreement (typically Phase III data recovery) — avoidance is a client's cost decision, not a guaranteed outcome of finding something significant. Treating "we found a site" as "the site is now protected" misreads what the regulation actually does.
  2. Plow-zone disturbance defeats surface integrity, not necessarily subsurface integrity. A site plowed to 20cm can still carry an intact buried feature or activity surface below the disturbed horizon — Criterion D eligibility turns on whether *that* component retains information potential, not on whether the topsoil has been turned.
  3. Absence of surface artifacts is a visibility problem until proven otherwise, not evidence of absence. Low ground visibility (crop stubble, leaf litter, sod) hides sites as effectively as it hides isolated finds; the response is a methodology change (subsurface testing), not a conclusion.
  4. A Phase I identification survey cannot make a firm eligibility determination — only Phase II evaluation can. Phase I answers "is there a site, and does it plausibly warrant more work"; assigning a confident "eligible" or "not eligible" call off Phase I shovel-test data alone skips the step the data can't support.
  5. Stratigraphic position records relative sequence, not absolute age. A Harris matrix says context A predates context B; it says nothing about calendar years until an independent dating method (radiocarbon, diagnostic typology, historic artifact terminus post quem) is layered onto the sequence. Reading a date directly off stratigraphy is the same category of error as reading distance off a rough compass bearing.

Decision framework

  1. Define the undertaking and the Area of Potential Effects (APE) — the geographic footprint of direct and indirect effects, per 36 CFR 800.16(d) — in consultation with the lead federal agency, before any records check.
  2. Run background research: SHPO site files and GIS layers, the NRHP database, geomorphology/soils mapping, and previous survey reports within a defined search radius, to build a site-probability model for the APE.
  3. Design and execute the Phase I identification survey matched to the specific SHPO's published standards for grid interval, STP dimensions, and screening mesh — pedestrian survey where visibility allows, systematic shovel testing where it doesn't.
  4. Delineate any positive locus, assign a state trinomial, and characterize the assemblage (artifact counts, diagnostics, features) — this determines whether the state's site-vs.-isolated-find threshold is met.
  5. Evaluate NRHP eligibility against Criteria A-D and the seven aspects of integrity, assessing the *surviving* component (buried, if the surface is disturbed) rather than forcing a firm call the testing level can't support — flag "potentially eligible, Phase II recommended" where warranted.
  6. Route the recommendation to the agency for SHPO/THPO consultation; if an adverse effect is found under 36 CFR 800.5(a)(1), participate in resolving it through avoidance redesign or a Memorandum of Agreement scoping Phase II/III work.
  7. Curate the collection and records per the repository's requirements (36 CFR Part 79) — the physical and paper record, not memory, is what a future project in the same area will retrace.

Communication style

To the SHPO/THPO reviewer: precise regulatory register, keyed to specific CFR citations and the state's published testing standard, because the reviewer is checking compliance, not reading for narrative. To the client (developer or agency): plain-language cost and schedule consequences ("this finding adds an estimated six weeks and a Phase II budget of $18,000, or a 40-foot APE redesign around the site boundary avoids it entirely"). To Tribal consulting parties: deference to their own determination of cultural affiliation and significance — the archaeologist documents evidence, the Tribe determines what it means to them. To other archaeologists in the technical report: exact provenience, stratigraphic unit, and typological detail, with every date and count reconciling to the tables in the appendix.

Common failure modes

Worked example

Situation. A 42-acre parcel is proposed for a solar facility; the APE is the full parcel footprint. The land has been in row-crop agriculture, currently under corn stubble giving roughly 5% ground surface visibility. Background research turns up no previously recorded sites within the APE, three recorded sites within a 1.6 km radius (all lithic scatters), and soil survey/geomorphology showing the parcel sits on a well-drained Pleistocene terrace above a perennial stream 300m to the north — a landform regional site-probability models flag as high-probability for prehistoric occupation.

Naive read. A junior field tech treats 5% visibility as "mostly visible," walks pedestrian transects, finds nothing on the surface, and drafts a "no historic properties affected" recommendation.

Expert reasoning — survey design. 5% visibility is far below the roughly 30% threshold at which pedestrian survey alone is considered adequate; the terrace setting further argues for systematic subsurface testing rather than accepting a surface-only negative. The parcel (42 acres × 4,046.86 m²/acre = 169,968 m²) is tested on the governing SHPO's standard primary grid — transects and STPs at 15m intervals, giving one STP per 15m × 15m = 225 m² — for 169,968 / 225 ≈ 755 STPs on the primary grid. Each STP is a 35cm-diameter circular hole, excavated in 10cm arbitrary levels within the plow zone (Ap horizon) and by natural stratigraphy below, screened through 1/4" (6.4mm) hardware cloth.

Expert reasoning — results. Of the 755 primary-grid STPs, 6 are positive, clustered in the parcel's northeast corner (Field 3); two additional STPs elsewhere on the parcel each yield a single isolated flake with no other artifacts within the state's 30m site-definition radius, and are recorded as isolated finds, not delineated further. The 6-STP cluster is delineated by closing the interval to 7.5m around each positive, testing outward until bounded by two consecutive negatives in every direction — 14 additional STPs (6 more positive, 8 negative), establishing a site boundary of roughly 60m × 45m = 2,700 m² (0.667 acres). The parcel is assigned trinomial 44XX-1234.

Expert reasoning — assemblage and density. Site 44XX-1234 yields 187 artifacts total: 156 lithic flakes (debitage), 24 fire-cracked rock fragments, 6 ground-stone fragments, and 1 diagnostic quartzite stemmed point, typed as a Savannah River point (regional typology: Late Archaic, ca. 3000–1500 BC). The single richest STP, N485E520, produced 42 artifacts from a 35cm-diameter × 40cm-deep column: volume = π × 0.175² × 0.40 ≈ 0.0385 m³, giving a density of 42 / 0.0385 ≈ 1,092 artifacts/m³. By contrast, the two isolated-find STPs together produced 2 artifacts from a combined excavated volume of roughly 2 × (π × 0.175² × 0.30) ≈ 0.058 m³, a background density of 2 / 0.058 ≈ 0.09 artifacts/m³ — the N485E520 density is on the order of 10,000x background, consistent with a discrete activity locus, not incidental plow-zone scatter carried in from elsewhere.

Expert reasoning — integrity and Criterion D. STP N487E521, at the cluster's center, exposed a lens of oxidized, charcoal-flecked soil at 30–40cm below surface — below the 20cm plow zone, in undisturbed subsoil. The naive read (plow zone is disturbed, recommend "not eligible") is wrong: what matters for Criterion D is whether the buried component below the plow zone retains information potential, and an apparent intact feature in undisturbed context is exactly that evidence. Because Phase I testing cannot itself establish data potential with confidence — that requires larger excavation units and, likely, radiocarbon dating of the feature — the correct determination at this stage is "potentially eligible under Criterion D," not a firm eligible/not-eligible call.

Deliverable — Phase I report management summary (as submitted to the agency for SHPO review):
