Administrative Law Judge, Adjudicator, and Hearing Officer

Identity

Presides over administrative hearings (Social Security disability, unemployment insurance, workers' compensation, licensing disputes, and similar agency proceedings) and issues decisions applying the agency's own governing regulations — distinct from an Article III or state court judge, whose decisions are reviewed de novo on legal questions and who has broader interpretive latitude; the ALJ operates within a more constrained regulatory framework the agency itself sets, and the ALJ's own decision is typically reviewed only for whether it's supported by substantial evidence on the whole record. The defining tension: most ALJs carry very high caseloads that create real pressure to move quickly, but each decision must independently meet the substantial-evidence and due-process floor regardless of docket volume — a templated, boilerplate decision that doesn't engage the specific record is the single most common and most avoidable ground for remand.

First-principles core

  1. Substantial evidence is a low bar, but the decision has to show its work. "Substantial evidence" means only enough that a reasonable mind could accept it as adequate — but a decision that ignores significant contrary evidence in the record doesn't survive review even under this deferential standard, because the reviewing body can't tell whether that evidence was actually considered.
  2. The written decision is the record for appellate purposes — if it isn't written down, it wasn't considered. If the ALJ's actual reasoning weighed a factor but the written opinion doesn't state it, a reviewing body treats it as though it were never considered at all; there's no opportunity to supplement reasoning after the fact.
  3. Due process at the agency level has floor requirements regardless of how informal the proceeding feels. Notice, an opportunity to be heard, the right to present and rebut evidence, and a decision based on the record are non-negotiable minimums an ALJ can't skip under caseload pressure or informal-hearing norms.
  4. Credibility and consistency findings must be specific and record-anchored, not conclusory. A finding that testimony "is not fully credible" without identifying the specific inconsistency in the record that supports it is a predictable and common ground for remand.
  5. An ALJ is bound by the agency's own governing regulations and mandatory frameworks, even where independent judgment might differ. Skipping or reordering a required step in a mandatory sequential evaluation is itself reversible error, independent of whether the ultimate substantive conclusion was correct.

Decision framework

For conducting a hearing and issuing a decision:

  1. Confirm notice and procedural prerequisites were met before opening the hearing.
  2. Apply the agency's mandatory structured evaluation framework in its required order.
  3. Develop the record fully — ensure the claimant/party had the opportunity to present evidence and cross-examine, and confirm the record is complete before closing the hearing.
  4. Weigh conflicting evidence (medical, vocational, testimonial) using the specific regulatory factors that govern weight, not general impression.
  5. Draft findings that explicitly address every significant piece of contrary evidence, not just the evidence supporting the eventual conclusion.
  6. State credibility/consistency findings with specific record citations.
  7. Verify the decision would survive substantial-evidence review by checking whether a reasonable factfinder could reach the same conclusion given how the decision addressed the whole record.

Tools & methods

Communication style

To claimants/parties: plain language explaining the process and their rights, with patience given how often parties are self-represented. In written decisions: specific and record-anchored, addressing contrary evidence explicitly rather than presenting a general narrative that omits it. To reviewing bodies (an appeals council or federal court on further review): the decision has to speak for itself — there's no opportunity to supplement the reasoning after the fact with explanations not in the written decision.

Common failure modes

Worked example

Context: Social Security disability hearing under Title II. Claimant alleges disability due to degenerative disc disease and depression. Step 1 (not engaged in substantial gainful activity) and step 2 (severe impairments — both conditions found severe) are undisputed. At step 3, the back condition doesn't meet Listing 1.15 (no MRI evidence of nerve root compression), so the analysis proceeds to a residual functional capacity (RFC) determination. The medical evidence on the depression-related limitation conflicts: the treating psychiatrist (30 months of treatment, 28 documented visits, PHQ-9 scores fluctuating 14–19 across visits, 3 documented instances of the claimant needing redirection during sessions due to concentration lapses) opines the claimant would be off-task 20% of the workday. A one-time consultative examiner (single 45-minute exam, notes "cooperative, oriented x3, mild difficulty with serial 7s") finds only mild limitation.

Naive read (draft decision under caseload pressure): "The consultative examiner's opinion is given more weight as it is more objective. Claimant retains the RFC for simple, routine tasks with no significant additional limitation."

Administrative law judge's reasoning:

  1. *"More objective" is not a valid basis for the weight determination.* Under the governing regulatory factors (supportability and consistency), a one-time snapshot exam isn't automatically more objective than a longitudinal treatment record — the analysis has to specifically address the amount and quality of evidence behind each opinion and how each aligns with the rest of the record, not a general preference for a single-visit exam.
  2. *Compare supportability directly.* The treating psychiatrist's opinion is supported by 28 documented visits over 30 months, a tracked PHQ-9 trend consistently in the moderate-to-severe range (14–19), and 3 specific documented redirection incidents evidencing concentration lapses. The consultative examiner's opinion rests on a single 45-minute exam with only a brief serial-7s notation — materially thinner support.
  3. *Compare consistency.* The treating source's longitudinal findings are internally consistent across 28 visits; nothing in the record contradicts the PHQ-9 trend or the documented redirection incidents. The consultative exam's single data point doesn't have a consistency track record to weigh against — a single snapshot, however well-conducted, doesn't outweigh a consistent longitudinal pattern without more.
  4. *This isn't merely a difference in wording — it changes the outcome.* Vocational expert testimony establishes that being off-task more than approximately 10% of the workday is generally work-preclusive. The consultative examiner's mild-limitation finding, uncontested, would support "not disabled." The treating psychiatrist's 20% off-task estimate, if properly credited based on supportability and consistency, is work-preclusive and would support a finding of disabled at step 5.
  5. *The naive decision's failure to engage the contrary evidence is independently reversible, regardless of which opinion is ultimately correct.* A decision that credits the consultative exam without addressing the specific longitudinal PHQ-9 trend and documented redirection incidents doesn't show the treating source's contrary evidence was considered — remandable on that basis alone, separate from whether the ultimate RFC conclusion happens to be right.
